ADULT GLAMPING

SLUMBER AND BOUNCE HOUSE PARTY PACKAGE TERMS OF SERVICES

These booking terms (the “Order Confirmation” or the Booking”) are part of the Agreement between Sweet Dreams Glamping located in Charlotte, NC and you the (“Customer”), as identified on the Booking. The Agreement comprise the entire agreement between the parties, and supersede all prior or contemporaneous understanding, agreements, negotiations, representations and warranties, and communications, both written and oral. In the event of any conflict between these Terms and the Order Confirmation, the Confirmation shall govern.

1. Payment

1.1) A non-refundable deposit of $100 is due to book and secure your date. An additional $50 dollars refundable payment is required ONLY if no deep cleaning is needed after rental pick up due to food, crumbs, shoe marks, food die, confetti, popped balloons etc. which all are not allowed inside of the bounce house. The $50 cleaning fee will be refunded back to the customer within 3 business days. The total deposit is $150. $100 nonrefundable and $50 refundable.

1.2) Full balance is due 24 hours prior to the event.

1.3) The initial $100 dollar deposit shall become non-refundable once it is paid to secure your date

2. Set-up and Installation

2.1) Unless otherwise agreed in writing, set-up shall occur the morning before the event;

2.2) Unless otherwise agreed in writing, Sweet Dreams Glamping shall not allocate time for a third-party set up (e.g. outside balloon vendor etc.);

2.3) Unless otherwise coordinated with Sweet Dreams Glamping, failure to provide access to the premises within fifteen minutes of the scheduled set up timeframe, $5 per minute will accrue and required to be paid by the (“Customer”) in a cash payment prior to the set up occurring.

2.4) Prior to Sweet Dreams Glamping arrival for the slumber party set-up, all furniture is required to be removed by the (“Customer”) from the area in which the set up will occur. Sweet Dreams Glamping under no circumstances will be required or responsible for the removable of any furniture located inside of the home or hotel prior to the set up.

2.5) In setting up the bounce house the (“Customer”) is to advise Sweet Dreams Glamping of the set-up location and must be aware of all underground pipes. Sweet Dreams Glamping is not responsible for any pipe issues or damages that may occur if the stakes puncture an unknown location of where a pipe maybe located. Sweet Dreams Glamping hold no responsibility of any damages with staking and securing the bounce house.

2.6) Sweet Dreams Glamping is required to take photos and videos of each slumber party set-up. All décor, linen and products are inspected upon leaving the (“Customer”) premises. If any product is damage or unable to be retrieved or located, Sweet Dreams Glamping will invoice the customer for the market rate price for the missing or damage product.

2.7) In terms of the bounce house, Sweet Dreams Glamping take photos and videos of the set-up and is inspected upon leaving. If food, drinks, shoe marks or any items listed in section 4. General Guidelines is found left inside and/or the bounce house is stained, the $50 dollar cleaning fee be nonrefundable.

3. Pick-up

3.1) Sweet Dreams Glamping will schedule the Slumber & Bounce House breakdown and pick up to occur the next day following the party and the expiration of the agreement term.

3.2) Unless otherwise and coordinated with Sweet Dreams Glamping, failure to provide access to the premises within fifteen minutes of the scheduled pick up or immediately following the expiration of this agreement, the (“Customer”) will be required to pay by cash another day of service, including a $100 late fee and other applicable fees.

4. General Guidelines

4.1) No food, drinks, chewing gum, or other food products are allowed inside of the bounce house.

4.2) No shoes, glasses, jewelry, badges, sharp objects and other personal property that may cause injury or harm to the children and the bounce house must be removed and must remain outside of the inflatable.

4.3) No face paint, party poppers, colored streamers, silly strings, or other party items are allowed inside the bounce house inflatable. If the nature of the party item shall cause damage to the inflatable, party item shall be used outside and away from the bounce house.

4.4) No climbing up the walls or sitting on the walls of the bounce house, including other unfavorable conduct.

4.5) Adult supervision and use of the bounce house inflatable is required at all times.

4.6) Maximum of 5 children at a time is allowed to occupy the bounce house inflatable at a time.

4.7) Adhere to all the rules, limitations, and guidelines as outline on the notices, warnings, and other labels adhered or otherwise attached to the bounce house inflatable.

4.8) No pushing, fighting, colliding, or other hoarse play that will likely and cause injury, distress to another child. Sweet Dreams Glamping hold no accountability to any injuries while the bounce house is in the (“Customer”) care.

4.9) No pets or other live beings, other than human beings aren’t allowed inside or beside the bounce house inflatable or inside of the slumber party teepee tents.

4.10) No bouncing on the entrance or front steps, including other unintended portion of the inflatables is not allowed.

4.11) No toys under any kind is not allowed inside of the bounce house inflatable.

4.12) For the slumber party set up, no jumping or standing on the inflatable beds. No pushing, fighting or colliding, or other hoarse play that will likely cause injury, distress to another child or to the teepee tents and décor. If any damages to the inflatable mattress, teepee tent or décor shall occur, Sweet Dreams Glamping shall invoice the (“Customer”) for the full cost to replace all damage items and décor.

4.13) The (“Customer”) is required to relocate or remove all participants from the inflatable if the blower stops working and perform the following troubleshooting steps:

1) Check the (“Customer”) breaker

2) Make sure the blower is connected to the outdoor electrical cord and outlet.

3) Make sure the two side zippers remain closed and zipped

4) If the blower overheats or looses power after a 3 minute delay, power the blower back up

5) Notify Sweet Dreams Glamping at (704)330-9041 or email:[email protected] if all the above attempts fails

4.14) The bounce house inflatable and other assets shall not be loaned, sublet, or otherwise disposed to anyone or any entity.

4.15) Sweet Dreams Glamping shall not be responsible for any damages to the (“Customer”) grass, sprinklers, pipes, cables, wires or other landscaping.

5. Release of Liability and Assumption of Risk

The (“Customer”), themselves or spouse, their children and guest attendees that desire to participate in the Sweet Dreams Glamping Slumber and Bounce House Party Package (whether singular or plural, hereinafter referred to as the “Activities”) with the teepee tents and décor, bounce house inflatable or other assets shall hereby and understand, acknowledges and agrees to the following:

5.1) WAIVING ANY AND ALL CLAIMS DUE TO ACTIVITIES
I (“CUSTOMER”), SPOUSE, MINOR CHILDREN, ALL GUEST ATTENDEES WAIVE ANY AND CLAIMS OF ANY KIND ARISING OUT OF OR ATTRIBUTABLE TO MY PARTICIPATION IN THE ACTIVITIES, INCLUDING THOSE CLAIMS THAT MAY BE UNKNOWN AND UNSUSPECTED, I HEREBY WAIVE ALL RIGHTS, BENEFITS AND PROTECTIONS I MAY HAVE UNDER NORTH CAROLINA CIVIL CODES.

5.2) WAIVING ANY AND ALL CLAIMS DUE TO PROPERTY DAMAGE
I (“CUSTOMER”), SPOUSE, MINOR CHILDREN, AND ALL GUEST ATTENDEES WAIVE AND RELEASE AND ALL CLAIMS WHICH I MAY HAVE, OR WHICH I MAY HEREAFTER HAVE, WHETHER KNOWN OR UNKNOWN, AGAINST SWEET DREAMS GLAMPING, AND IT MANAGER (S), EMPLOYEES, AND ASSIGNS (COLLECTIVELY “RELEASES”) ON ACCOUNT OF INJURY, DEATH, OR PROPERTY DAMAGES ARISING OUT OF OR ATTRIBUTABLE TO MAY PARTICIPATION IN THE ACTIVITES WHETHER ARISING OUT OF THE ORDINARY NEGLIGENCE OF SWEET DREAMS GLAMPING. I COVENANT NOT TO MAKE OR BRING ANY SUCH CLAIM AGAINST SWEET DREAMS GLAMPING OR ANY OTHER RELEASES, AND FOREVER RELEASE AND DISCHARGE SWEET DREAMS GLAMPING AND RELEASES FROM LIABILITY UNDER SUCH CLAIMS.

5.3) INDEMNIFICATION
I (“CUSTOMER”), SPOUSE, MINOR CHILDERN, AND GUEST ATTENDEES, SHALL DEFEND, INDEMNIFY AND HOLD HARMLES SWEET DREAMS GLAMPING AND ALL OTHER RELEASES AGAINST ANY AND ALL LOSSES, DAMAGES, LIABILITIES, DEFICIENCIES, CLAIMS, ACTIONS, JUDGEMENTS, SETTLEMENTS, INTEREST, AWARDS, PENALITIES, FINES, COSTS OR EXPENSES OF WHATEVER KIND, INCLUDIN ATTORNEY FEES, FEES AND THE COSTS OF ENFORCING ANY RIGHT TO INDEMNIFICATION UNDER THIS AGREEMENT, AND THE COST OF PURSUING ANY INSURANCE PROVIDERS, AWARDED AGAINST INDEMNIFIED PARTY IN A FINAL JUDGEMENT, ARISING OUT OF OR RESULTING FROM ANY CLAIM OF A THIRD PARTY RELATED TO MY PARTICIPATION IN THE ACTIVITES, INCLUDING ANY CLAMS ARISING OUT OF MY OWN NEGLIGENCE OR THE ORDINARY NEGLIGENCE OF SWEET DREAMS GLAMPING.

5.4) ACKNOWLEDGMENT TO VOLUNTARILY WAIVER OF LEGAL RIGHTS
BY BOOKING THE SERVICES, I (“CUSTOMER”) ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTAND ALL F THE TERMS OF THIS AGREEMENT AND I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE SWEET DREAMS GLAMPING FOR CLAIMS, WHETHER KNOWN OR UNKNOWN, ARISING OUT OF MY PARTICIPATION IN THE ACTIVITIES.

6. Customer’s Obligations. Customer shall complete the following:

6.1) Reimburse Sweet Dreams Glamping for all costs, fees, and other expenses and charges associated with damages to Sweet Dreams Glamping bounce house inflatable (currently $3,500), equipment and assets and return the damaged assets even after full reimbursement.

6.2) For the slumber party, I (“Customer”) will reimburse Sweet Dreams Glamping for all cost, fees, and other expenses and charges associated with damages to the teepee tents, inflatable mattress, and all décor at the current market price with shipping and handling. I (“Customer”) is required to return the damaged assets back to Sweet Dreams Glamping even after full reimbursement.

6.3) Respond promptly to any Sweet Dreams Glamping request to provide direction, information, approval, authorization, or directions that are reasonably necessary for Sweet Dreams Glamping to perform Services in accordance with the requirement of this Agreement.

6.4) Ensure the total final invoice for services being offered is paid in full three days prior to Sweet Dreams Glamping arrival date.

6.5) I (“Customer”) will protect, monitor and prevent all of Sweet Dreams Glamping décor, teepee tents, inflatable mattress, bounce house inflatable, equipment and other assets from being stollen or misplaced. If any items are stolen, I (“Customer”) will reimburse Sweet Dreams Glamping at the full market price including shipping and handling.

6.6) I (“Customer”) will ensure that all precautions are taken to avoid injuries during the Services and to the Assets.

By checking here, you are consenting to the use of your electronic signature in lieu of an original signature on paper.  You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may upon written request to Sweet Dreams Glamping, obtain a paper copy of electronic record.   No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use electronic signature with us for any documentation will continue until such time as you notify Sweet Dreams Glamping in writing that you no longer wish to use an electronic signature.  There is no penalty for withdrawing your consent.  You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
